NAVI MUMBAI: The Navi Mumbai Municipal Corporation (NMMC) has granted a provisional occupancy certificate (OC) to the affluent Palm Beach Residency in Nerul, which is owned by Amey Cooperative Housing Society Limited (ACHSL), thirteen years after it was built. The complex had to pay a staggering ₹100 crore for the OC, with ₹66.67 crore going to NMMC and around ₹34 crore to CIDCO for different licenses. The complex was embroiled in litigation because of construction infractions totaling more than 3 lakh square feet.
For decades, the project has been enmeshed in dispute. Prior to selling the property to the Wadhwa group, there were claims of irregularities in the way CIDCO distributed land to six “phony” cooperative societies of APMC Mathadis that had amalgamated. When the project was eventually finished in 2012, after being approved by the Supreme Court, FSI breaches were discovered, and NMMC declined to give an OC.
In 2018, social activist Sandeep Thakur petitioned the Bombay High Court to take action against the individuals occupying the premises illegally. In order to get authorization, the group also submitted a writ petition.

In October 2024, the HC gave NMMC permission to decide whether to regularize the building. On December 31, 2024, NMMC issued an order agreeing to provide an OC, contingent on penalty payment, extra premium, and other requirements. As an interim measure, the court on March 4 permitted the deposit of the amount to NMMC, asking it to issue the OC which, it stated, would be provisional in nature and subject to further orders.
How Palm Beach Residency OC Was Finally Granted After 13 Years of Legal Battles
The regularization was made possible by the new Unified Development Control and Promotion Regulations, which allow for more FSI, according to Somnath Kekan, assistant director of town planning at NMMC. The locals were “keeping it low-key, as we believe that this is the time to maintain calmness and composure,” according to ACHSL chairman Uma Ahuja.
However, Thakur stated that the court’s earlier decisions, which barred the sale or purchase of the units, applied to the provisional OC. He said, “It is also subject to the validity of ‘consent to operate’ being confirmed by MPCB, which is conducting an inquiry.” “The society lacks environmental clearances, and at the upcoming hearing on July 8, we will discuss the concerns regarding the licenses granted by MCZMA and SEIAA. We will request that the provisional OC be canceled.
